Rules determining the citizenship of children born of cross-strait marriages amended in Articles 4 and 5 of the Enforcement Rules for the Act Governing Relations Between the People of the Taiwan Area and the Mainland Area promulgated on May 30, 2018

According to Subparagraph 4, Paragraph 1, of Article 4 and Subparagraph 2 of Article 5 of the Enforcement Rules for the Act Governing Relations Between the People of the Taiwan Area and the Mainland Area, children who were born in China from a cross-strait marriage but have no household registration in China and do not hold a passport issued by China but make a household registration in Taiwan within one year of birth are considered citizens of Taiwan. If a household registration is not made in Taiwan within one year of birth, then the child is considered a citizen of China.
