The Standard of Naturalization Is Loosened. It Is No Longer A Dream to Get ID Card.

Nationality Act was amended and passed in 2015, and it loosens the regulations of naturalization and provides online naturalization courses and grades check-up services, which makes getting ID Card no longer a dream for new immigrants.

Nationality Act Was Amended and Passed in 2015

The amendments of partial articles of Nationality Act were promulgated and implemented on December 21, 2015. The details of Nationality Act amendments are as follows:


1.Foreign spouses do not need to provide financial proof for their naturalization. 

2.The legal time of residence is reduced from 5 years to 3 years for foreign spouses who are divorced due to domestic violence or widowed without getting married again but are still in touch with their husband’s or wife’s family or supporting minor children of Taiwan nationality. 

3.Foreigners who apply for naturalization can get permission first and then supply the verification of losing their original nationality. 

4.Those who have special contributions to Taiwan or professionals who bring benefits to Taiwan can be naturalized without losing their original nationality. 

5.Before retracting the naturalization permit, Ministry of the Interior will have a review meeting to give the applicant an opportunity for the petition, except for those whose naturalization due to fraudulent marriage ruled by the judicial court or due to adaptation. Relevant Acts and Regulations for Foreign Spouses’ Residence and the Procedure of Naturalization

Step1: Register marriage at the Household Registration Office.


Step 2: Apply for a residence permit at the Ministry of Foreign Affairs.


Step 3: Apply for “Alien Residence Certificate” at the National Immigration Agency Service Station.


Step 4: After three years of residence, apply for “Taiwan Nationality Naturalization” at the Household Registration Office.

(Generally, foreigners who apply for naturalization need to reside legally for five years. Foreign spouses who apply for naturalization need to reside legally for three years and can show the evidence of residing Taiwan for more than 183 years per year; in addition, they need to have basic Chinese language skills and knowledge about rights and obligations of Taiwanese citizens.)


‧Naturalized foreign spouses should provide one of the three following document as evidence to show they have basic Chinese language skills and knowledge of rights and obligations of Taiwanese citizens:

1.Evidence that shows attending schools of any levels in Taiwan for more than one year. 

2.Evidence that shows the total number of hours of attending courses offered by Taiwanese governmental agencies or accumulated hours of attending courses for more than 72 hours. 

3.Participating in naturalization examinations (written examination or oral examination) and scoring more than 60 points. Those who are more than 65 years old should score more than 50 points.


Step 5: Those who know the naturalization date after receiving permit for their application of naturalization or those who are permitted to lose their original nationality at a certain age due to their countries’ regulations should provide evidence of losing their county’s nationality when they reach the aforementioned age and apply for “Taiwan Residence Certificate” at National Immigration Agency.


Step 6: Once can apply for “Permanent Residence Certificate” at National Immigration Agency after residing in Taiwan for a certain amount of time. 

(One has to reside in Taiwan for a certain amount f time after applying for Permanent Residence Certificate of Taiwan. One should have one year of continuous residence from the date of residence approval, have two years of residence with more than 270 days of residence per year, or have five years of residence with more than 183 days of residence per year.)


Step 7: Establish household registration at the Household Registration Office and get an ID Card.



In addition, foreign spouses who are divorced due to domestic violence or widowed without getting married again and are still in touch with their husband’s or wife’s family, or who stay in marriage for more than two years without getting married again but still supporting minor children, shouldering rights and obligations, and interacting with children are eligible for loosened regulations when applying for naturalization. Ministry of the Interior’s Department of Household Registration adds a new search, “Course Hours and Naturalization Examination Search for Foreigners,” to its website to provide foreigners with convenient services to check whether they meet the standards of naturalization.



Loosening Naturalization Application Process for Minors Who Have No Guardians and Are Non-Taiwanese

Children and adolescents who are born in Taiwan but do not have Taiwan Nationality are identified according to the following criteria: 

1.One’s biological mother is a foreigner and biological father a Taiwanese.  The biological father can go through a legal claim process to enable one to have Taiwan nationality.


2.One’s biological mother is a foreigner and biological father a foreigner or unknown.  One will have the same foreign nationality with one’s biological mother or biological father.


3.Both one’s biological mother and biological father are unknown.  One will be considered having Taiwan nationality.


4.One’s biological mother is a foreigner who has left Taiwan or is repatriated to her home country with unknown whereabouts, and one’s biological father is unknown.  After searching for one’s biological mother or contacting her home country for more than three months without any responses, one is considered a stateless person. After adopting by a Taiwanese citizen, one can apply for naturalization according to the Nationality Act. If one is not adopted by anyone, social welfare agencies will be the representatives to apply for naturalization for the stateless person.

New Immigrations Can Enjoy Citizenship After Obtaining ID Card. 

New immigrants will become Taiwanese citizens after obtaining ID Card and have citizenship according to law. For relevant information, please visit our website and search “New Immigrants’ Citizenship.”

.Right to Vote: One can vote for the candidate or political party one likes. 

.Right to Recall: One can remove and replace an elected public official who has been in service for one year through voting before their legal term is reached. 

.Right of Suffrage: One can participate in the decision-making process of the Constitution, laws, legislative principles, local autonomy laws, and other major policies through voting. 

.Donation of Political Contribution: One has the right to support political parties or persons who intend to register for the election by donating cash or goods.



The amended Nationality Act loosens relevant regulations of naturalization. Naturalized new immigrants can enjoy a variety of social welfare. Generally, it takes about six years for spouses from Mainland China to obtain Taiwan’s ID Card, and four years for other foreign spouses.
