Prohibition of Employment Discrimination

According to Article 5-1 of Employment Service Law, “For the purpose of ensuring national’s equal opportunity in employment, employer is prohibited from discriminating against any job applicant or employee on the basis of race, class, language, thought, religion, political party, place of origin, place of birth, gender, gender orientation, age, marital status, appearance, facial features, disability, or past membership in any labor union; matters stated clearly in other laws shall be followed in priority.”
When looking for employment or being employed currently, new immigrants may find employers violating the abovementioned regulation about the prohibition of discrimination. If such matter is found, new immigrants can file complaints to labor administrative agencies (special municipal, city or county governments or Department of Social Affairs ) that locate at the same place as they work and provide detailed information (such as name and the address of the employed institution, the situation of discrimination) to ensure their rights are protected.
