Sexual Harassment Victim Protection and Assistance Measures

In the case of sexual harassment, new immigrants who file complaints and seek help from protection and assistance measures will receive services no different from other Taiwanese citizens. The complaint filing process for sexual harassment will follow Article 13 of Sexual Harassment Prevention Act, which states that victims can file complaints to the assailant’s affiliated organizations, troops, schools, institutions, employers, or municipal or county governments within one year after the incident happened, and the case will be investigated by the assailant’s affiliated organizations, troops, schools, institutions, employers, or municipal or county governments. If the whereabouts of the assailant is unknown or the assailant is not affiliated with any institutions, the case will be investigated by the local police agencies. If the involved parties are not satisfied with the investigation result, they can file a further appeal for municipal, city, or county governments. Municipal, city, or county governments that accept the appeal cases will form an investigation team to investigate the cases according to Article 14 of this Act and inform the involved parties of the investigation results. If the involved parties still have different opinions on the administrative penalty accrued from investigation results, they can file an appeal or administrative litigation procedure according to the Administrative Appeal Act.

In the course of investigation of sexual harassment incidents, the involved parties, depending on their physical and mental state and needs, can have counseling and legal assistance provided by their affiliated organizations, troops, schools, institutions, employers, or municipal or county governments according to the Article 21 of Regulations of Sexual Harassment Prevention.
